Terms of Use

The short version: ParTrek gives you a personal licence to use the app. Optional Pro features are sold as an auto-renewing subscription through Apple, with a 14-day free trial — cancel any time in your App Store settings before the trial ends and you won't be charged. Your data stays on your device, and the app is provided as-is.

1. Who we are and what these terms cover

ParTrek is a golf scorecard app for iPhone, published by Corneil Efoma ("we", "us"). These Terms of Use are an agreement between you and us — not Apple — and they govern your use of the ParTrek app and any paid features in it. By downloading or using ParTrek you agree to these terms. Where required, these terms incorporate Apple's minimum terms for licensed applications.

2. Your licence to use ParTrek

We grant you a personal, non-exclusive, non-transferable licence to install and use ParTrek on Apple devices that you own or control, for your own personal, non-commercial use, as permitted by the App Store terms. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app, except where the law expressly allows it.

3. Subscriptions, free trial and billing

ParTrek Pro is an optional auto-renewing subscription: £1.99 per month or £12.99 per year (or the equivalent in your local currency, as shown on the App Store payment sheet).
14-day free trial: new subscribers get 14 days free. If you don't cancel at least 24 hours before the trial ends, your subscription starts automatically and you're charged the plan price.
Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours before the period ends.
Cancelling: manage or cancel any time in your device's Settings → your Apple account → Subscriptions. Deleting the app does not cancel a subscription.
Payments and refunds are handled entirely by Apple. Refund requests go through Apple at reportaproblem.apple.com; we never see your payment details.
Price changes: if a price changes, Apple will notify you in advance and, where required, ask you to agree before you're charged the new price. Unused portions of a free trial are forfeited when you start a paid subscription.

4. Your data

ParTrek stores your rounds, practice sessions and stats on your device only — there's no account and no server of ours holding your data. See our Privacy Policy for the full picture. You are responsible for backing up your device; if you delete the app, your ParTrek data goes with it.

5. Acceptable use

You agree not to use ParTrek unlawfully, to interfere with or disrupt the app or its distribution, or to misrepresent the app or its content as your own. You must comply with any applicable third-party terms (for example, your mobile carrier's terms) when using the app.

6. Changes to the app and these terms

We may update, change, or discontinue features of ParTrek over time. If we make material changes to these terms, we'll update this page and the "Last updated" date above, and note the change in the App Store release notes. Continuing to use the app after a change means you accept the updated terms.

7. Disclaimer of warranties

ParTrek is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee that the app will be uninterrupted or error-free, or that scores, statistics, or insights will be accurate. Nothing in these terms affects the statutory rights you have as a consumer that cannot be excluded by law.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of ParTrek, including loss of data. Our total liability for any claim relating to the app is limited to the amount you paid us for the app in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

9. Apple's role

These terms are between you and us. Apple has no obligation to provide maintenance or support for ParTrek and is not responsible for addressing claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. In the event ParTrek fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation for the app.

10. Termination

These terms apply for as long as you use ParTrek. They end automatically if you breach them. You can end them at any time by deleting the app (remember to cancel any active subscription separately through your Apple account).

11. Governing law

These terms are governed by the laws of England and Wales, and any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales, without affecting mandatory consumer protections in your country of residence.
